West Virginia Asbestos Lawsuit Filed Against Nearly 70 Companies

In Charleston, West Virginia, a couple has filed an asbestos-related lawsuit against 66 companies. The husband and wife filed the suit in response to the onset of the husband’s asbestosis and mesothelioma. These two serious medical conditions are caused by asbestos exposure, often over a long period of time such as during the course of a person’s working life.

Mesothelioma affects less than 3,000 Americans each year, and while there are palliative treatment methods available, including chemotherapy, the cancer is always fatal. Patients perish anywhere from several weeks to several years after being diagnosed. However, the disease typically lies dormant for up to fifty years before an individual begins to suffer from mesothelioma symptoms.

The couple, Richard H. Pullen and Rebecca Pullen, argue that the companies named in the suit exposed Mr. Pullen to asbestos and other harmful materials. In addition, the defendant companies failed to “exercise reasonable care” to warn Mr. Pullen of the health risks associated with asbestos exposure. According to government agencies such as the US Environmental Protection Agency, there is no level of exposure to asbestos-containing materials which is considered safe. The companies named in the suit used asbestos to create certain products.

Pullen says that he has suffered, and is seeking damages to pay for “medical treatment, drugs and other unknown remedial medical measures; great pain of the body and mind; embarrassment and inconvenience; loss of earning capacity; loss of enjoyment of life; and shortening of his life expectancy”, according to local sources.
